Subject: 9820/Code/18-123,-124/Landfill Fees & Wood Chips Date: Mon, 27 Feb 1989 12:20:00 -0500 ORDINANCE NO. 9820 AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, PART II, SECTION 18-123, RELATIVE TO LANDFILL FEES, AND TO ADD A NEW SECTION 18-124, RELATIVE TO WOOD CHIPS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE: SECTION 1. That Chattanooga City Code, Part II, Article VII, Section 18-123, as amended, be and the same is hereby further amended by deleting therefrom subparagraphs (a) through (i), and substituting in lieu thereof new subparagraphs (a) through (h) as follows: (a) Residents of the city delivering refuse in automobiles, station wagons, standard size pick-up trucks and small trailers shall be charged no fee for dumping. (b) Non-residents of the city delivering refuse in automobiles, station wagons, standard size pick-up trucks and small trailers shall be charged ten dollars ($10.00) per load for dumping. (c) All private collectors, municipalities, government agencies, contractors or others depositing waste shall be charged at the rate of twenty-two dollars ($22.00) per ton for dumping, with a minimum of seventeen and 60/100 dollars ($17.60) per load. (d) In addition to the fees specified hereinabove, there shall be a surcharge of one hundred dollars ($100.00) per load of waste for the disposal of materials requiring special handling by landfill personnel and equipment, including those specified in 0C section 18-104 and those materials for which special handling is required by the Tennessee Department of Environment and Conservation, or other regulating agencies. There shall be a surcharge of two hundred dollars ($200.00) per load of waste for the disposal of asbestos. (e) Any person depositing industrial waste which may be hazardous or which is of questionable origin or composition, requiring monitoring through laboratory analysis in the discretion of the landfill operator, shall pay an additional forty dollars ($40.00) per load administrative fee plus the cost of laboratory analysis together with any other expenses directly related to handling the particular load of waste. (f) All brush and wood waste that is disposed of at the wood recycling facility shall be charged at the rate of ten dollars ($10.00) per ton, with a minimum of five dollars ($5.00) per load. Provided that city residents disposing of such waste from their own property shall not be charged for a pick-up load of such wastes. (g) In addition to the other landfill fees provided hereinabove, there shall be imposed a surcharge of one dollar ($1.00) per ton for each ton of municipal solid waste received at the landfill. (h) Notwithstanding the provisions of paragraphs (c) and (f) above, governmental agencies or private non-profit corporations funded by governmental agencies for the purpose of providing safe and sanitary housing for residents of Chattanooga or for the removal of dangerous or blighted structures including, but not limited to, the Chattanooga Housing Authority, the Chattanooga Neighborhood Enterprises, Inc. and the Better Housing Commission, shall not be charged for the disposal of demolition waste. SECTION 2. That Chattanooga City Code, Part II, Article VII, be amended so as to add a new Section 18-124 as follows: Sec. 18-124. Wood Chips. Wood chips will be available for purchase by the public at the wood recycling facility at the rate of two dollars ($2.00) per yard during regular operating hours and subject to availability and reasonable operating restrictions that may be established by the Administrator of the Department of Public Works. SECTION 3. That this ordinance shall be effective two (2) weeks from and after its passage as provided by law.
